  • Do all pools and spas have to be registered?

    Yes. As of 1 December 2019, it’s now law to register your pool and have an official inspection of your pool fence barrier in Victoria, Australia. This applies to all pools and spas that can hold more than 300mm of water, in-ground pools and spas and wading pools. 

  • If I don’t have children, must I still register my pool?

    Yes. The law states that all landowners, with a swimming pool or spa in Victoria, must have their pool registered and hold a barrier compliance certificate.


    There have been 27 cases of drowning in Victoria since 2000. 12 of the individuals who drowned did not live on the property of the incident. Furthermore, in an isolated incident, a child accessed the swimming pool without the knowledge of the property owner. 

  • Do I have to cut my trees down?

    If the tree is climbable and falls within a designated ‘no climb’ zone as determined by your inspector. However, depending on where and how the tree branches are growing, could also just be a trim of the tree.  

  • What does the date of construction mean?

    A pool that’s constructed today has different legislations than a pool that was built 20 years ago. Therefore, after you apply to register your pool, the council, through a series of tests and data, determine when your pool was built and apply the relevant barrier standards.  

  • Does my pool gate have to latch from any position to be compliant?

    Yes. 


    This is a safety feature to ensure that the pool can be accessed whether you are poolside or on the other side. The latch must also be high enough so that children can’t reach to open it. 

  • Can my house doors be opening onto the pool?

    If it’s within the standard which was allowed when your pool was built, then it’s fine. Provided that the door is self-closing, self-latching and complies with the standards of when it was built.  

  • If I live in an apartment or complex with a communal pool/spa, am I responsible for the pool fence compliance?

    No. All of the registering and compliance responsibility falls on the owner’s corporation of the complex or apartment block. 

  • What happens if I don’t lodge my barrier compliance certificate?

    Pool owners have up to 60 days to submit their certificates. 

    Failure to do so can result in a fine of $330 and a further penalty fine of up to $1652.20. 

  • Can I do my own repairs?

    Yes you can, as long as those repairs compliant.
